On January 3rd, 2011 protester Jawaher Abu Rahmah was killed by a tear gas inhalation at an earlier march in Bil’in. At the time, the Israeli Army made some bizarre claims that her death was caused by cancer, which they later retracted. Now almost a year later on December 9th, another nonviolent marcher has been killed in their own village, this time Mustafa Tamimi. You can read eyewitness testimony of his shooting here. The short version to respond to @IDFSpokesman victim-blaming question of what he did to to shot: save a friend’s life.

Tamimi appeared in this TOD? post about the Israeli army criminalizing Palestinians having guests.. No word yet on the current excuses by Israeli Army, or how they intend to stop this from happening in the future, but these events are as good an illustration as any that the Israeli government learned nothing in 2011.

Mustafa Tamimi, a 28 year old resident of Nabi Saleh, was shot in the face yesterday, during the weekly protest in the village of Nabi Saleh. He sustained a critical head injury, under his right eye, and was evacuated to the Belinson hospital in Petah Tikwa. The severe trauma to Tamimi’s brain, caused by the shooting, left the doctors with little to do to save his life, and he eventually passed away at 09:21 AM today.

Tamimi’s funeral will take place tomorrow, leaving Ramallah at 10:00 AM towards Nabi Saleh, where it is expected to reach at around 11:00 AM.

Mustafa Tamimi (left) a moment before his injury. Circled in red are the barrel of the gun and the projectile that hit him. Picture credit: Haim Scwarczenberg

A photo of the incident shows Tamimi at a distance of less than 10 meters behind the semi-open door of an armored military jeep with the gun aimed directly at him. Clearly visible in the photo is also the tear-gas projectile flying in his direction.

The incident took place in the West Bank village of Nabi Saleh today, when dozens gathered for the weekly demonstration in the village, protesting the theft of village lands by the adjacent Jewish-only settlement of Nabi Saleh. After the army dispersed the peaceful march, minor clashes erupted followed by a severe response from the Israeli forces. Several people were hit with rubber-coated bullets and directly shot tear-gas projectiles. Three were evacuated to the Ramallah hospital for further treatment, including a 14 year-old. One protester was arrested.

In complete disregard to the army’s own open fire regulations, soldiers often shoot tear-gas projectiles directly at groups of protesters or individuals. Rubber-coated bullets are indiscriminately shot at protesters from short distances on a regular basis. The Israeli army also resumed the use of high velocity tear-gas projectiles in Nabi Saleh, despite the fact that they have been declared banned for use, after causing the death of Bassem Abu Rahmah in the neighboring village of Bil’in, in April 2009, and the critical injury of American protester Tristan Anderson in Ni’ilin in March of the same year.

The demonstrations, which have been held regularly for the past two years have seen hundreds of injuries to protesters by Israeli forces, as well as dozens of arrests carried out by Israel with the aim of suppressing dissent.

Six years after their struggle has begun and four years after the Israeli High Court has ordered the rerouting of the Wall on Bil’in’s lands, residents of the village will finally have free access to 600 dunams (150 acres) of land that were previously sequestered behind the Wall.

While continuing to fight for the remaining 1350 dunams (330 acres) that are effectively annexed to the settlement of Modi’in Illit, the Bil’in Popular Committee announced a new strategy of building community and public buildings on lands that were given back as a way to assert their possession of them.

The regained land is designated as Area C, over which Israel retains complete control of both security and administrative matters. Due to this fact, it is nearly impossible for Palestinians to receive building permits in area C. Palestinian structures built without permit in Area C are often demolished by Israeli authorities and are almost never retroactively whitewashed. In contrast, illegal and unpermitted settlement construction is often retroactively issued the required construction permits, as was the case in the Matityahu East neighborhood of the Modi’in Illit Settlement, which was built on Bil’in’s lands.

Background
On the morning of Tuesday, the 21st of June, army bulldozers began work to dismantle the Wall in Bil’in. As early as 2007, after two years of weekly protests in the village and following a petition filed by the residents, Israeli high court declared the path of the Barrier illegal. The court ruled that the route was not devised according to security standards, but rather for the purpose of settlement expansion. Despite the high court’s ruling four more years of struggle had to elapse for the army to begin dismantlement. During these years two people were killed in the course of the weekly protests and many others injured.
Yet even according to the new path, sanctioned by the high court, 435 acres of village land will remain on the “Israeli” side of the Barrier.

On September 4th, 2007, the high court ordered the state to come up with an alternative path for the existing Barrier in Bil’in within a reasonable period of time. Despite the ruling, many months elapsed and no new plan was offered. On the May 29th, 2008, the residents of Bil’in filed a petition to hold the state in contempt of the court due to this delay. In response to the petition, the state offered an alternative path. However, the plan failed to comply with the high court’s ruling as the proffered path left a large area designed for settlement expansion on the “Israeli” side of the Barrier. The only difference between the two paths being that the latter offered to award 40 acres of land back to the residents.

A second petition claiming the alternative path not in accordance with court ruling was then filed. On August 3rd, 2008, the court declared that the first alternative path indeed fails to adhere to the ruling. The court ordered the state to come up with another alternative path.

On September 16th, 2008, the state offered a second alternative path. This path also left a large area designed for settlement expansion on the “Israeli” side, offering to return a100 acres of village land to the residents. A lawyer for the residents asked that the state be held in contempt of the court for violating a court ruling for the second time.

On December 15th, 2008, the high court ruled that the second alternative path was not in accordance with the original court ruling.

In April 2009 the state offered a third alternative path which left most of the area destined for settlement expansion on the “Palestian” side of the Barrier, thereby returning to the village 150 acres of 490 acres annexed by the original path.

In a triumph of the obvious truth over incoherent lies, the Israeli Army now admits that Jawaher Abu Rahmah was indeed killed by tear gas at a demo, not as their anonymous speculation would have it by cancer or an honor killing. These tales violated basic plausibility, but they did provide animplausible denial, which is all Israeli government’s supporters need to fan out online with the narrative that there were “doubts about her death.” The new Army version still blames Palestinians for not treating her better. We know from the Republican Party’s tactics in the United States that such attempt to create doubts actually unfortunately work.

We know from the Republican Party’s tactics in the United States that such attempt to create doubts actually unfortunately work.

Here is the actual truth, from +972 Magazine.

As Yossi Gurvitz notes, the army’s story was released (again) through unofficial channels, and not by IDF spokesperson. Harretz’s piece, as well as other reports in the Hebrew media, indicates that the source of the story was at Central Command. The fact that same story appeared on all media outlets suggests that Central Command’s CO Avi Mizrachi was personally involved in releasing it.

After the protest, Palestinian sources claimed that Jawahar Abu Rahmah stood on a hill near her home, not far from the protest, inhaled massive amounts of tear gas and as a result, collapsed. She was rushed to Ramallah’s hospital, where she died the next day.

In the following days, the army presented several versions for the event. It claimed that Abu-Rahmah died at her home, that she died of cancer, and that she wasn’t present at the protest or hurt from tear gas. An army source even spread a vicious rumor that Jawahar was murdered by a Palestinian for violating her family’s honor

The current IDF version contradicts all previous ones.

The army currently admits that Jawaher was hurt from the tear gas which was shot in Bil’in on December 31st.”

Jawaher Abu Rahmah, 36, was evacuated to the Ramallah hospital yesterday after inhaling massive amounts of tear-gas during the weekly protest in Bil’in, and died of poisoning this morning. Abu Rahmah was the sister of Bassem Abu Rahmah who was also killed during a peaceful protest in Bil’in on April 17th, 2010.

Doctors at the Ramallah hospital fought for Jawaher Abu Rahmah’s life all night at the Ramallah Hospital, but were unable to save her life. Abu Rahmah suffered from severe asphyxiation caused by tear-gas inhalation yesterday in Bil’in, and was evacuated to the Ramallah hospital unconscious. She was diagnosed as suffering from poisoning caused by the active ingredient in the tear-gas, and did not respond to treatment.

Mohammed Khatib, a member of the Bil’in Popular Committee said this morning: “We are shocked and furious for Israel’s brutality, which once again cost the life of a peaceful demonstrator. Israel’s lethal and inhumane response to our struggle will not pass. In the dawn of a new decade, it is time for the world to ask Israel for accountability and to bring about an end to the occupation.”

Lawyer Michael Sfard, who represents the village in an appeal against the Wall added: “The son was killed by a directly aimed projectile, the daughter choked in gas. Two brave protestors against a regime that kills the innocent and doesn’t investigate its criminals. We will not quiet, we will not give up, we will not spare any effort until those responsible will be punished. And they will.”

Video of Adeeb Abu Rahmah being released

On a personal note, I remember very clearly the weekend that Adeeb was arrested. I was still living in Israel, and a friend from Anarchists Against the Wall was arrested with him. This friend was detained for over 24 hours, blindfolded, etc. This was fairly harsh treatment for a Jewish Israeli, and he told me all about it on our way to visit Tristan Anderson.
It’s still amazing to me to think that Adeeb spent a year and a half in jail for doing EXACTLY what an Israeli spent 24 hours in jail for. It’s so thrilling to see him at home, but so infuriating that he was there at all….
Here’s Popular Struggle’s account of Adeeb’s release from Ofer Military Prison.

After serving an eighteen month jail serving for organizing unarmed demonstrations in Bil’in, Adeeb Abu Rahmah is a free man. Before he had even reached the gate of Ofer military compound, Adeeb Abu Rahmah had his hands in the air in celebration. Abu Rahmah crossed the iron gate of the compound and walked into freedom after eighteen months in military prison. Despite the frigid mountain air, the warmth of Adeeb’s presence could be felt strongly by all present. He embraced his daughters immediately with tears in his eyes. With barely a moment to catch his breath, Adeeb kissed and hugged everyone that was present, occasionally throwing his hand high in the air with a peace sign and yelling out one of the many chants that are common on demonstration days in Bil’in.

<img title="Adeeb Abu Rahmah Moments After He was Released from Ofer Military Prision. Adeeb Abu Rahmah Moments After He was Released from Ofer Military Prision. Picture Credit:Oren Ziv/Activestills.org

A taxi driver and father of nine who has been active in the unarmed resistance in Bilin from its outset, Adeed Abu Rahmah was arrested in Bil’in on July 10, 2009 while taking part in one of the weekly Friday protests. The Israeli army accused him of participation in ‘violent demonstrations’ against the Israeli separation wall, presence in a ‘closed Israeli military zone’ and disturbing public order.

From the jail, a large procession of cars drove slowly towards Bil’in with music blaring, flags flying and lots of honking. Once in Bil’in, fireworks, dancing and chanting filled the winter air as the village broke out in celebration. Banners covered houses with pictures of Adeeb demanding a ‘release to the prisoners of the Popular Struggle.’ Among those greeting Adeeb were a handful of Israelis and internationals. As the wind and rain continued pounding Bil’in, the celebration moved inside. In the long battle of non-violence in the West Bank, a small victory was felt in Bil’in last night.

Unfortunately, Adeeb will be under a suspended sentence and under orders not to resume his human rights organizing. He was suspended from participating in any political activity for a period of four years, though there were hints this would be lifted sooner.. Should Abu Rahmah be caught within this period, he will be fined 6,000 NIS ($1600), around on charges of “incitement” and obstructing the work of the army by conducting peaceful demonstrations against the Wall in Bil’in.

Here is him obstructing injustice by leading a protest in Bil’in August, 2008.
In yet another nighttime raid on the village of Bil’in, soldiers stormed Adeeb Abu Rahmah’s house and arrested his sixteen year old son

At 2:30 AM this morning Israeli forces entered the village of Bil’in in armored military jeeps and by foot, and proceeded to surround the home of jailed organizer, Adeeb Abu Rahmah. A group of masked soldiers forcefully entered the house without showing a warrant, and arrested Adeeb’s only son, 16 year old Mohammed. Since his father’s arrest 17 months ago Mohammed serves as the family’s sole provider.

Background

Adeeb Abu Rahmah, 38, a taxi-driver and father of nine and courageous activist, was arrested during one of the weekly protests in Bil’in on July 10th, 2009. An initial decision to release him on condition of avoiding demonstrations was reversed on July 21st, 2009 when the military prosecution appealed. A judge ruled he should be kept on remand until the end of the legal proceedings against him.

<img title="Haitham Khatib showing his bruises after the raid.
Eventually sentenced on June 30th, 2010, he was convicted of “incitement” and “activity against the public order”. These broad military orders are increasingly being used by Israel to criminalize peaceful protest.

Abu Rahmah was initially sentenced to a twelve months term, which was then aggravated to an eighteen months term by the Military Court of appeals in a highly controversial ruling that won the contempt of Human Rights organizations around the world.

Amnesty International, amongst others, noted that “The broad scope of Israeli military orders mean that Adeeb Abu Rahma could be imprisoned solely for legitimately exercising his right to freedom of expression in opposing Israeli policies in the West Bank.” They added that he should be regarded “as a prisoner of conscience who should be released immediately and unconditionally.”

Military Judge Orders to Keep Bil’in Organizer Jailed Even After He Has Finished Serving His Sentence in Full

Abdallah Abu Rahmah was scheduled to be released from prison last Thursday, after having served the one-year prison term he was sentenced to. He remains in jail after the Military Court of Appeals ordered today to keep him behind bars regardless, pending a decision in the Military Prosecution’s appeal of the sentence.

Judge Lt Colonel Aharon Mishnayot, the head of the Military Court of Appeals, accepted the military prosecution’s petition today to extend the detention of Abdallah Abu Rahmah past the term he was sentenced to, which ended last Thursday. The decision comes after a dramatic hearing last Thursday, on the Military Prosecution’s last minute petition to extend Abu Rahmah’s remand, which took place on the date of his scheduled release. The decision contradicts the jurisprudence of the Israeli Supreme Court on the issue, instructing that a prisoner should only be kept under arrest after his term was over in the most extraordinary of cases.

Gaby Lasky, Abu Rahmah’s layer said: “The decision to keep Abdallah Abu Rahmah detained even after his sentence has ended is a mockery of the very concept of justice, but comes as no surprise. The military prosecution and courts are a well oiled machine of politically motivated unfair legal process.”

Last month, on October 11th, Abu Rahmah was sentenced to twelve months imprisonment for his prominent role in his village’s successful campaign against the construction of Israel’s Separation Barrier on its lands. Abu Rahmah was convicted freedom of speech charges, incitement and organizing illegal demonstrations, but was cleared of all charges connecting him with violence.

Abu Rahmah was declared a human rights defender by the European Union, and his conviction and sentence generated international outrage, and was denounced by human rights organizations and the international community alike, including EU foreign policy chief, Catherine Ashton.

In the similar case of Adeeb Abu Rahmah – another Bil’in activist – the Military Court of Appeals has recently ordered the Bil’in organizer under remand despite the fact that he served his sentence in full. The Court of appeals eventually dramatically harshened the one-year sentence originally imposed on Adeeb Abu Rahmah by the first instance, increasing it by half to 18 months imprisonment.

Click here to see the judge’s decision (in Hebrew)

Background
Abu Rahmah, the coordinator of the Bil’in Popular Committee Against the Wall and Settlements, was arrested last year by soldiers who raided his home at the middle of the night and was subsequently indicted before an Israeli military court on unsubstantiated charges that included stone-throwing and arms possession. Abu Rahmah was cleared of both the stone-throwing and arms possession charges, butconvicted of organizing illegal demonstrations and incitement.

An exemplary case of mal-use of the Israeli military legal system in the West Bank for the purpose of silencing legitimate political dissent, Abu Rahmah’s conviction was subject to harsh international criticism. The EU foreign policy chief, Catherine Ashton, expressed her deep concern “that the possible imprisonment of Mr Abu Rahma is intended to prevent him and other Palestinians from exercising their legitimate right to protest[...]“, after EU diplomats attended all hearings in Abu Rahmah’s case. Ashton’s statement was followed by one from the Spanish Parliament.

Renowned South African human right activist, Archbishop Desmond Tutu, called on Israel to overturn Abu Rahmah’s conviction on behalf of the Elders, a group of international public figures noted as elder statesmen, peace activists, and human rights advocates, brought together by Nelson Mandela. Members of the Elders, including Tutu, have met with Abu Rahmah on their visit to Bil’in prior to his arrest.

International human rights organization Amnesty International condemned Abu Rahmah’s conviction as an assault on the right to freedom of expression. Human Rights Watch denounced the conviction, pronouncing the whole process “an unfair trial”.

Legal Background
Abu Rahmah, the coordinator of the Bil’in Popular Committee Against the Wall and Settlements, was acquitted of two out of the four charges brought against him in the indictment – stone-throwing and a ridiculous and vindictive arms possession charge. According to the indictment, Abu Rahmah collected used tear-gas projectiles and bullet casings shot at demonstrators, with the intention of exhibiting them to show the violence used against demonstrators. This absurd charge is a clear example of how eager the military prosecution is to use legal procedures as a tool to silence and smear unarmed dissent.

The court did, however, find Abu Rahmah guilty of two of the most draconian anti-free speech articles in military legislation: incitement, and organizing and participating in illegal demonstrations. It did so based only on testimonies of minors who were arrested in the middle of the night and denied their right to legal counsel, and despite acknowledging significant ills in their questioning.

The court was also undeterred by the fact that the prosecution failed to provide any concrete evidence implicating Abu Rahmah in any way, despite the fact that all demonstrations in Bil’in are systematically filmed by the army.

Under military law, incitement is defined as “The attempt, verbally or otherwise, to influence public opinion in the Area in a way that may disturb the public peace or public order” (section 7(a) of the Order Concerning Prohibition of Activities of Incitement and Hostile Propaganda (no.101), 1967), and carries a 10 years maximal sentence.

I recently had the good fortune to attend a packed Monday night NYC screening sponsored by Jewish Voice for Peace and the American Arab Anti-Discrimination Committee. One issue raised by the extremely well-informed director was how similar protests in other villages have had difficulty duplicating Budrus’s success. A Budrus protest participant told me that even Budrus itself could see its victory threatened as Israel completes the building of the Wall. So it is inspiring to me that Ayed Morrar, the Budrus leader, has continued to struggle on behalf of other less fortunate villages in the West Bank. Here he writes in Huffington Post (apparently more “mainstream” outlets passed on it) in support of Abdallah Abu Rahmah, his counterpart organizer in Bi’lin.

Our struggle’s success and the consequent expansion of civil resistance to other West Bank communities may provide hope to viewers desperate for positive news from the Middle East, but today an Israeli crackdown on unarmed Palestinian protesters is threatening this growing movement. For our movement to thrive and serve as a true alternative to violence, we need Americans’ to demand that Israel, a close US ally, end this repression.

Budrus depicts our ten month campaign of protest marches in 2003-2004, which included participation by men, women and children, and by representatives from all Palestinian political factions, along with Israeli and international activists, to resist the construction of Israel’s Separation Barrier on our lands. Young women, led by my 15-year-old daughter Iltezam, ran past armed Israeli soldiers and jumped In front of the bulldozers that were uprooting our ancient olive trees. The soldiers regularly met us with clubs, rubber-coated bullets, curfews, arrests and even live ammunition. But we won in the end. The Israeli military rerouted the barrier in Budrus, allowing us access to almost all of our land.

The film ends with Palestinian and Israeli activists heading to the neighboring village of Ni’ilin where the struggle to save Palestinian land continues today. But following Budrus’s success and faced by a growing numbers of civilians protesting the confiscation of their lands, Israel has responded with military might, attempting to quell this new movement. Twenty Palestinians have since been killed during unarmed demonstrations against the construction of the Separation Barrier.

In Ni’ilin, in the dark of night, Israeli soldiers have staged hundreds of military raids and arrests of civilians from the village; hundreds more were injured — forty by live ammunition, and five, including a ten year old, were shot dead. Today, a horrid 25 foot concrete wall stands in Ni’ilin, behind which lie 620 acres of village lands taken for the expansion of illegal Israeli settlements.

Through a five-year protest campaign, another nearby village, Bil’in, has become an international symbol of nonviolent resistance to Israeli occupation, with world leaders from Jimmy Carter to Desmond Tutu visiting to show support. On October 11th, Abdallah Abu Rahmah, one of Bil’in’s most prominent protest organizers, was sentenced by an Israeli military court to twelve months in jail. His crime — leading demonstrations in his village that were very similar to those I led in Budrus.

During Abdallah’s trial, Israel’s military prosecution repeatedly demanded that an ‘example’ be made of him to deter others who might organize civil resistance. The EU, Britain, Human Rights Watch and Amnesty International have all condemned Abdallah’s incarceration, yet he remains in prison.

Palestinians’ wishes are simple — we want what is ours, our land, with true sovereignty. We want freedom, equality and civil rights — what Martin Luther King, Jr. called in his Letter from a Birmingham Jail “our constitutional and God-given rights.”

But Israel is sending a clear message — even unarmed resistance by ordinary civilians demanding basic rights will be crushed. It is little known that the second intifada began not with guns and suicide bombings against civilians, but rather with protest marches to Israeli military checkpoints inside the occupied West Bank, and with civil disobedience in the tradition of the US civil rights movement. Israel responded by firing over 1.3 million live bullets in one month into crowds of protesters. When ordinary people could no longer afford to risk protesting, small groups turned, in anger and despair, to armed resistance.

Budrus’s struggle showed that civil resistance can bring down walls, both literal and those of the heart, and set an example for a bright future for Israelis and Palestinians in this biblical land. Today Palestinian and Israeli protesters are together confronting Israel’s military occupation in other villages. But this hopeful possibility is now threatened again by Israeli bullets and arrests.

For this future to materialize, those who are outraged by the violence deployed against protesters must demand an end to the injustice. If Americans want to see the example of Budrus continue to spread, individuals, civil society groups and the US government must act to pressure Israel to end its brutal crackdown on civilian protesters.

from the Popular Struggle Coordination Committee

Bil’in protest organizer Abdallah Abu Rahmah was sentenced to 12 months imprisonment today, for his involvement in his village’s unarmed struggle against the wall.

Abdallah Abu Rahmah was sentenced today to 12 months in prison, plus 6 months suspended sentence for 3 years and a fine of 5,000 NIS. In the sentencing, the judge cited the non-implementation of an Israeli High Court ruling which declared the current route of the wall on Bil’in’s land illegal as a mitigating factor.
The military prosecution is likely to appeal this sentencing – as they did in the case of Adeeb Abu Rahmah, who was also sentenced for 12 months on similar charges but is still in prison after 15 months, pending the decision about the prosecution’s appeal. The defense attorney, adv. Gaby Lasky, is considering an appeal against ...

Today’s sentencing hearing was attended by diplomats from the United Kingdom, the European Union, Belgium, Germany along with representatives of UNSCO and Human Rights Watch.

“The Israeli army, which served as prosecutor, judge and jury in this case, is try to use Abu Rahmah to set an example that will deter people from protesting.
